Spa Approvals & Council Compliance: Simplified

Under WA building laws, a spa is classified as a major building structure. Explore your options to manage council lodgement yourself or let TotalSPA deliver complete, certified peace of mind.

Important: Why Spas Require a BA1 Building Permit in WA

Under the Building Act 2011 and Building Regulations 2012, any private spa or swimming pool capable of holding water to a depth greater than 300 mm (30 cm) is legally classified as a Class 10b major building structure.

  • BA1 Permit Requirement: A certified building permit application (Form BA1) accompanied by an independent Certificate of Design Compliance (CDC) must be approved by your Local Government Authority before installation starts.
  • Structural & Engineering Verification: Because a filled spa can weigh multiple tonnes, foundations (concrete slabs or reinforced engineered decks), electrical bonding, and setback boundaries must be certified.
  • No Lockable Lid Exemptions in WA: Unlike NSW or ACT rules, Western Australia regulations mandate that lockable hard covers do not replace safety barriers—a permanent compliant safety barrier must enclose the spa.

Choose Your Approval Pathway

You have the statutory right to lodge building applications yourself or engage TotalSPA to take care of every detail from drafting to council sign-off.

Option 1

Self-Managed (DIY) Approval

Best for homeowners experienced with technical drafting, council liaison, and coordinating private building surveyors.

What You Manage:

  • Produce scaled site plans, property setbacks, water authority easements, and pad specifications.
  • Engage an independent registered building surveyor for a Certificate of Design Compliance (BA3) or lodge uncertified directly via Form BA2.
  • Ensure barrier geometry strictly satisfies AS 1926.1-2012 and maintain 900 mm Non-Climbable Zones (NCZ) clear of heat pumps or steps.
  • Assume full statutory builder responsibility on the permit application.
  • Submit the mandatory Notice of Completion (Form BA7) to council within 7 days of installation.
Note: Missing plans or non-compliant boundary setbacks will result in council requests for information, pausing statutory assessment timeframes.

Option 2

TotalSPA Turnkey Approval

Best for owners wanting a fully compliant, zero-stress installation managed by licensed spa installation professionals.

  • Certified Fast-Track Lodgement: We coordinate the building surveyor CDC and lodge the certified Form BA1 application directly to council.
  • AS 1926.1 Compliance Planning: Non-climbable zone auditing for heat pump placement, steps, decking, and boundary fences.
  • End-to-End Coordination: Delivery pathways, foundation pads, electrical circuit setup, and barrier alignments handled in one scope.
  • Close-Out & BA7 Filing: Final installation sign-offs and regulatory completion notices prepared and submitted for you.
